Philadelphia attorneys Christopher Gilligan and Daniel Renk secured a complete appellate victory in the Third Circuit Court of Appeals, which affirmed the Middle District of Pennsylvania’s dismissal with prejudice of all Constitutional claims brought against their clients.
The plaintiff asserted numerous federal and state law claims arising out of prior state court proceedings. In their motion to dismiss, Christopher and Daniel argued that one claim was barred under the Younger Abstention and Rooker-Feldman doctrines, which prohibit federal courts from interfering with or reviewing state court judgments. They further argued that the remaining federal claims failed to allege any Constitutional violations and that the court should decline to exercise jurisdiction over the state law claims.
The District Court agreed and dismissed the action with prejudice. On appeal, the Third Circuit affirmed the dismissal in full, upholding judgment in favor of the firm’s clients.
