Within three months of receiving the file, Margolis Edelstein partner Paul Carbon secured a voluntary dismissal for a client in a multi-party construction defect lawsuit brought by a condominium association. Plaintiff alleged construction defects and misrepresentations in the design, planning, and construction of the New Visions condominium community located in Brick, New Jersey. Plaintiff alleged that the client provided Leadership in Energy and Environmental Design (“LEED”) design and construction administrative services to co-defendants and that there were construction deficiencies related to that work. In his Motion to Dismiss, Paul argued that the client had no involvement nor provided any work or services for the project. Plaintiff thereafter stipulated to the dismissal of all claims against the client.
