Summary Judgment Awarded in Pediatric Tonsillectomy Death Case

This case involved allegations of unnecessary tonsillectomy which led to the home death of a seven (7) year old girl three (3) days post-op as a result respiratory arrest precipitated by overwhelming sepsis and prescribed codeine pain medication. The defense assembled exceptionally well credentialed experts in the specialty fields of otolaryngology, pediatrics, pediatric infectious disease, toxicology and pediatric pathology in support of the defense of our ENT physician client.   After 3 years of extensive discovery, the Centre County Court dismissed the case in it’s entirety upon our motion for summary judgment which was premised upon deficiencies in the Plaintiffs’ produced experts.
