Pittsburgh Partner James Harvey Secures Dismissal Of Insurance Agents E&O Case


Mr. Harvey successfully defended an insurance agency against allegations that it should have secured commercial coverage for business activities conducted at Plaintiffs’ home. Plaintffs also sued the Homeowners’ insurer for failure to cover a fire loss in a garage in which plaintiffs had stored woodworking tools and equipment. In deposition, Mr. Harvey secured admissions from plaintiffs that they did not disclose any business activities in the insurance application, they “received exactly the coverage that they had requested,” they never told the agent of other commercial insurance that they had carried on the premises, and that the agent “didn’t do anything wrong.” After considering Jim’s Motion for Summary Judgment, counsel for Plaintiffs agreed to dismissal of the agent.
