Philadelphia partner, Tamara Chasan, Esquire, secured a defense verdict in early June after a 6 day trial in the Court of Common Pleas of Philadelphia County in front of Judge Matthew Carrafiello. Ms. Chasan represented the owners and managers of a large residential apartment complex located in Elkins Park, PA. The plaintiff, a tenant in the complex, alleged that a layer of algae on his balcony caused him to slip and fall suffering cartilage damage and a complete detachment of the medial meniscus in the right knee. Plaintiff had a surgical repair of the right knee and will need a total knee replacement in the future. The alleged damages included a wage loss claim of in excess of $1.3 million. After hearing testimony from multiple fact witnesses, and from medical, vocational, economic and liability experts for both sides, the jury found that there had been no negligence. No post trial motions were filed. The final demand prior to trial had been $4.75 million.
