In September 2024, Kate Sears secured a defense win in a rear-end motor vehicle accident case in Delaware County. The plaintiff, involved in a minimal-damage collision, alleged strain and sprain injuries but later passed away from unrelated causes.
At the arbitration hearing, Kate successfully argued that the plaintiff’s injuries and treatment—seven months of physical therapy without emergency care, injections, or surgery—were insufficient to overcome the limited tort option in the plaintiff’s car insurance policy. The arbitration panel ruled in favor of our client.
