Beaver partner Michael Lang successfully defended a car dealership against claims of fraud, intentional and negligent misrepresentation, and violations of Pennsylvania’s Unfair Trade Practices and Consumer Protection Law. The plaintiff alleged that the dealership “tricked” her into purchasing a vehicle when she believed she was obtaining a loaner car after a near-fatal accident.
At trial, Mike demonstrated that the plaintiff signed extensive purchase documents, made a $1,000 deposit, and spent significant time at the dealership completing the sale. He also established that her income was accurately submitted to multiple lenders in accordance with the dealership’s financing guidelines and Pennsylvania regulations, and that there was no near-fatal accident prompting the visit to the dealership.
The jury returned a full defense verdict on all fraud and misrepresentation claims, and the Court entered judgment for the defense on the UTPCPL claim.
