Defense Award for Partner Stephen Banko in Binding Arbitration

Harrisburg partner, Stephen L. Banko, Jr., represented a national machine manufacturing company in a products liability case in which it was alleged that a panel cutter was defective and such defect resulted in the amputation of Plaintiff’s thumb and a severe laceration to his index finger.  The thumb was successfully reattached surgically.  The parties agreed to binding high-low arbitration.  After a hearing on liability and damages, the single Arbitrator ruled in favor of Mr. Banko’s client holding that there was not sufficient evidence to establish a defect in the panel cutter.
