Plaintiff claimed that missing paint on steps created a dangerous condition that caused her fall and sought to impose liability on our client, which provided cleaning services at the location.

Restaurant Negligence Matter Dismissed in Erie County, Pennsylvania

Pittsburgh attorneys Jen DeFlitch and Ron Reitz successfully positioned the matter for dismissal after the plaintiff passed away on March 17, 2025 and plaintiff’s counsel failed to take the necessary procedural steps to continue the action. Despite indicating an intent to substitute an administrator, plaintiff’s counsel neither filed a substitution nor notified the court of the plaintiff’s death.

Defense Secures Summary Judgment in Cumberland County, PA Premises Liability Action

In a recent Cumberland County premises liability matter, Harrisburg partner Barry Kronthal obtained summary judgment where the plaintiff alleged serious injuries after falling down an interior staircase that lacked handrails. The plaintiff and her spouse asserted negligence and loss‑of‑consortium claims, supported by expert opinions criticizing the staircase’s construction and the absence of handrails and signage. However, during her deposition, the plaintiff acknowledged she had used the stairs many times before and ultimately could not identify what caused her to fall, a critical gap in her proof.
