Plaintiff Voluntarily Dismisses All Claims With Prejudice in New Jersey Professional Liability Lawsuit

Philadelphia Partner John Nolan successfully secured a full dismissal for a New Jersey nail salon client that had been sued for negligence after a customer alleged he developed a serious finger infection following a manicure. Through a detailed deposition of the plaintiff, John uncovered significant weaknesses in his case, including medical complications related to preexisting diabetes and inconsistencies surrounding his alleged visit to the salon. Notably, Plaintiff even identified the wrong nail salon as the defendant. These admissions, coupled with the absence of supporting medical evidence, revealed that plaintiff could not establish the necessary elements of his claim.

Following the deposition, the defense  prepared to pursue a series of strategic motions, highlighting the procedural and evidentiary deficiencies in plaintiff’s case. Confronted with these challenges, plaintiff’s counsel ultimately chose to voluntarily dismiss all claims against our client before the motions were filed, securing a swift and favorable resolution for the salon.
