Philadelphia partner John Livingood secured a complete dismissal of a high exposure commercial action in the Philadelphia Court of Common Pleas, Commerce Program. John successfully advanced preliminary objections challenging personal jurisdiction, resulting in the Court sustaining the objections and dismissing the complaint in its entirety at the outset of the case.
The case arose from a nationwide product recall involving a complex, multi party supply chain. Plaintiffs, including insurance subrogees, sought recovery for alleged losses exceeding $60 million tied to the recall. Following targeted jurisdictional discovery and briefing, the Court determined that the defendant lacked sufficient contacts with Pennsylvania to support either general or specific jurisdiction. The record established that the defendant was headquartered outside Pennsylvania, maintained no meaningful presence in the forum, and did not purposefully direct the conduct giving rise to the claims toward the Commonwealth. The Court further held that downstream distribution of products into Pennsylvania was insufficient to establish jurisdiction.
This result underscores the value of early, strategic jurisdictional challenges in high stakes commercial and product related litigation. By obtaining dismissal at the preliminary objections stage, the defense avoided protracted discovery and litigation, securing an efficient outcome in a multi million dollar dispute.
