Our Harrisburg partner Rolf Kroll obtained dismissal of Plaintiff’s federal and state civil rights claims, first in federal court by way of Motion to Dismiss and then in state court by way of Preliminary Objections. The Plaintiff failed to follow both state and federal transfer laws thus leading to the claim being time-barred under Pennsylvania statute of limitations law. The Pennsylvania Commonwealth Court upheld the trial court’s dismissal. The case is currently pending appeal to the Pennsylvania Supreme Court.
