New Jersey State Court Grants Motion for Summary Judgment, Dismissing Plaintiffs’ Complaint with Prejudice

Margolis Edelstein partner Ana Baranowski with briefing support from associates Shannon Byrne and Alyssa Spadel successfully defended an employment action brought pursuant to New Jersey’s Conscientious Employee Protection Act, where four plaintiffs alleged they were constructively discharged from their employment.

The team established that our client took no retaliatory action with respect to the Plaintiffs, as the Plaintiffs could not point to any specific retaliatory behavior exhibited by any of the Defendants. In addition to thorough briefing with assistance by Shannon and Alyssa, at oral argument, Ana pointed the Court’s attention to case law that specifically requires an employer’s behavior to be so egregious and intolerable a reasonable person could not continue their employment. Despite Plaintiffs’ reliance on their reasonable beliefs there may have been a violation of law or public policy, the Court granted summary judgment, eliminating all claims against our clients.
