In a recent rear-end automobile accident matter, Philadelphia attorneys Kevin Monastra and Chris Thagard conceded negligence on our client’s behalf, narrowing the dispute to the nature and extent of the plaintiff’s alleged injuries and available damages. The plaintiff asserted that his injuries met Pennsylvania’s Full Tort threshold and sought recovery for pain and suffering.
The arbitration panel rejected that position and determined that the plaintiff was subject to the Limited Tort election. As a result, the panel awarded only $3,450 for outstanding medical expenses and declined to award any damages for pain and suffering.
