Arbitration Panel Rules for Defense in Montgomery County Slip and Fall Case

In October 2025, Richard DiNapoli secured a defense victory in a premises liability case involving an alleged slip and fall. The plaintiff claimed that he slipped on a wet outdoor staircase at our client’s resort located in Florida and injured his knee. The plaintiff, however, could not affirmatively show the presence of wetness on the stair or any other cause for his fall.

At the arbitration hearing, Richard successfully argued that the plaintiff had not proven his case for liability and could not do so based on his evidence presented. Furthermore, Richard introduced countervailing evidence that our client’s employees responded to the plaintiff’s fall and observed no condition or defect on the stairs. The panel ruled in our client’s favor. The case was overseen by partner Carol Ann Murphy, whose strategic guidance ensured a strong defense throughout the proceedings.
