Superior Court Reiterates – No Prejudgment Interest on Mechanic’s Liens in Pennsylvania

On April 23, 2010, the Pennsylvania Superior Court confirmed that there is no prejudgment interest available as part of a mechanic’s lien claim in Brubacher Excavating, Inc. v. Commerce Bank/Harrisburg, N.A. 2010 Pa. Super. 67 (2010).  The Court reiterated that interest is only available at the statutory rate of 6% from the date judgment is entered on mechanic’s lien.  In addition, the Brubacher Court clarified the application of pre-construction lien waivers created before 2006 amendments to the mechanic’s lien law when the work and subcontracts were created after the effective date of the law.
