Partner Christopher Tinari and Associate Emily Mahler Prevail on Summary Judgment in Age Discrimination Lawsuit

Philadelphia Partner Christopher Tinari and Pittsburgh Associate Emily Mahler obtained summary judgment resulting in the dismissal of an Age Discrimination suit filed in the United States District Court for the Eastern District of Pennsylvania against a large health care corporation. Plaintiff alleged discrimination in the course of her employment and termination from the company on the basis of her age in violation of the Age Discrimination in Employment (ADEA) and Pennsylvania Human Relations Act (PHRA), and claimed extensive damages including back pay, front pay, compensatory and punitive damages. Summary Judgment was granted in favor of our client and judgment entered against Plaintiff on all counts, on the basis that Plaintiff could not demonstrate that the company’s asserted basis for her discharge was pretext for age discrimination.
