Defense Verdict for Harrisburg Partner, Stephen Banko, on Behalf of National Truck Stop Operator in Slip and Fall Case

On January 14, 2010, a federal court jury in Williamsport, PA, took less than one half hour to return a unanimous verdict of no negligence against Plaintiff and in favor of TA Operating, LLC, the owner and operator of a Travel Center in Lamar, PA.  Plaintiff, a resident of Oregon, claimed that he slipped and fell on February 28, 2007, after stepping off a curb and onto ice, suffering a left ankle fracture, a strain of the medial collateral ligament, and a torn meniscus in his left knee.  Plaintiff further claimed that the parking lot was not properly lighted.  Defense evidence, however, demonstrated that Plaintiff fell while attempting to step over a snow bank and that the lot was properly plowed, salted and lighted.  Plaintiff presented special damages of nearly $88,000.00. Shortly before trial, Plaintiff lowered his settlement demand to $150,000.00.  Plaintiff rejected a $50,000.00 offer.
