In response to recent developments in the area of Employment Practices Liability (EPL) the Firm has established a separate unit in our professional lines practice group. This area of the law is affected by a multitude of statutes and regulations at both Federal and State levels. EPL is a significant market for the insurance industry and coverages are still evolving. We are often called upon to render opinions regarding the nature of the coverage's afforded and the likely interpretation a particular court may reach. Our firm entered the employment practices arena in the 1970's with a race discrimination case involving Title VII. Since that time we have represented clients before various U.S. Courts of Appeal, the Pennsylvania Supreme Court and the United States Supreme Court.
Moreover, in addition to its representation of clients in EPL-related litigation, the Firm also provides strategic counseling to clients on such diverse and wide-ranging labor and employment law topics as employee handbooks, drug and alcohol testing, internal complaint procedures, compliance with federal and state EEO and family leave laws, hiring and background checks, wage and hour compliance, employee privacy, union avoidance, and the prevention of sexual harassment and other forms of prohibited workplace discrimination. The Firm's practice also includes counseling clients on demotion and promotion issues, reductions-in-force, separation and severance agreements, and the elimination of unfair competition through the utilization of non-compete and non-disclosure agreements.
In sum, the goal of the Firm's counseling work in this field of the law is to provide sound strategies and advice to help minimize risk and avoid liability by proactively partnering with clients to craft practical solutions that promote the client's needs within applicable legal frameworks.
